3. Calls, Text Messages, and Emails
Text Messaging Data and Consent
Obamacare Hotline values your privacy and ensures that your text messaging originator opt-in data and consent will not be shared, sold, rented, or disclosed with any third parties under any circumstances. This includes phone numbers, message content, and consent data provided for text messaging purposes.
Phone numbers and SMS consent will not be shared, sold, rented, or disclosed to any third parties for marketing purposes.
Information we collect. When you sign up to receive text messages from Obamacare Hotline, we collect your mobile phone number, the date and time you gave consent, and any details you provide on the sign-up form, such as your name and email address.
How we use it. We use your mobile number to send you the messages you agreed to receive. These may include appointment and account reminders, replies to your questions, enrollment-period reminders, and, where you have separately agreed, promotional offers.
How we obtain your consent. We collect consent through an opt-in form on obamacarehotline.com, where you actively tick a checkbox to agree to receive text messages. Consent is never a condition of purchase.
How to opt out. You can opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us at (844) 944-7526 or service@obamacarehotline.com. By calling this number, you will reach a licensed insurance agent.
Security. We protect the information we hold using industry-standard safeguards, including restricted access and secure storage.
Retention and deletion. We keep your mobile number and consent record for as long as you remain opted in, and after that only as long as we are required to for legal and regulatory purposes. You may request deletion by contacting us at service@obamacarehotline.com.
Calls and text messages
When you provide your telephone number and give the applicable consent, Obamacare Hotline may contact you by telephone or text message about your inquiry, consultation, insurance options, application, enrollment, policy servicing, appointment reminders, or other matters you authorized.
Depending on the consent presented when your information is collected, communications may be made using automated technology.
Consent to receive marketing calls or text messages is not a condition of purchasing insurance. Message and data rates may apply. Message frequency may vary, up to 20 messages per week. Our full SMS program terms are set out on our Terms and Conditions page.
You can opt out of text messages at any time by replying STOP to any message; reply HELP for help. You may also withdraw consent to other marketing communications by telling a representative you do not wish to receive marketing calls, asking to be placed on our internal Do-Not-Call list, or contacting us using the information in the “Contact Us” section below.
After you opt out of marketing, we may continue to contact you when reasonably necessary to respond to your request, administer an application or policy, provide requested customer service, or send legally required communications.
Mobile opt-in information and consent to receive text messages will not be sold or shared with any third parties or affiliates for their own marketing or promotional purposes. Messages are delivered through our messaging provider.
You may unsubscribe from promotional emails by using the unsubscribe link included in the message or by contacting us. Even after unsubscribing from promotional email, you may continue to receive non-promotional messages concerning an appointment, application, insurance policy, customer-service request, legal notice, or other ongoing business relationship.
4. Call Recording
Telephone calls may be monitored or recorded for quality assurance, training, recordkeeping, fraud prevention, and compliance purposes.
When applicable, we provide notice that a call is being recorded. Certain calls and records may be retained for the period required by the Health Insurance Marketplace, insurance carriers, or applicable law.
By continuing a call after receiving a recording notice, you consent to the recording to the extent permitted by law. When legally required, we will obtain additional consent.
5. How We Disclose Personal Information
We do not sell your personal information, and we do not share it with other insurance agencies, marketing organizations, or lead buyers for their own use or marketing. We disclose personal information only in the circumstances described below.
Insurance carriers and the Marketplace
At your direction, we may provide information to an insurance carrier or the Health Insurance Marketplace to:
- Obtain plan information or a quote;
- Determine product availability or eligibility for financial help;
- Complete or submit an application;
- Process enrollment;
- Service an existing policy; or
- Resolve a customer-service matter.
The carrier’s or Marketplace’s processing of information is governed by its own privacy practices and applicable law.
Service providers
We use companies that perform services on our behalf, including services involving:
- Website hosting and security;
- Customer and lead management;
- Appointment scheduling;
- Telephone, email, and text-message communications;
- Data storage and backup;
- Analytics and website-performance measurement;
- Advertising measurement;
- Recordkeeping;
- Professional, legal, accounting, or compliance support; and
- Fraud prevention and information security.
These service providers may receive personal information only as reasonably necessary to perform services for us and are required to protect it and use it only for those services. They are not permitted to use your information for their own marketing.
Advertising and analytics companies
We may use analytics and advertising technologies to understand website traffic, improve our content, measure advertising results, and reach audiences who may be interested in our services. These technologies may collect device, browser, cookie, and website-interaction information. Depending on applicable state law, some advertising-related disclosures may be considered “sharing” or “targeted advertising,” even when no money is exchanged.
We do not knowingly provide information about your medications, healthcare providers, medical conditions, income, or insurance application to advertising platforms for targeted advertising.
Legal and safety purposes
We may disclose information when we reasonably believe disclosure is necessary or appropriate to:
- Comply with a law, regulation, subpoena, court order, government inquiry, or legal process;
- Respond to the Health Insurance Marketplace, an insurance regulator, an insurance carrier, or another authorized oversight body;
- Investigate or prevent fraud, misuse, security threats, or unlawful conduct;
- Protect the rights, safety, and property of our clients, our business, or others; or
- Establish, exercise, or defend legal claims.
Business transactions
Information may be transferred as part of a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable law.
With your direction or consent
We may disclose information to another person or organization when you direct us to do so, request the disclosure, or provide consent.
6. Sale of Personal Information
We do not sell personal information for money.
Some state privacy laws define “sale,” “sharing,” or “targeted advertising” broadly and may apply those terms to certain advertising or analytics technologies. Where required, you may request to opt out as described in the “Your Privacy Rights” section.
7. Cookies and Tracking Choices
Most browsers allow you to block, limit, or delete cookies through browser settings. Blocking cookies may affect certain website features.
Our website has a cookie control, described below, that lets you manage nonessential technologies.
Analytics and your choice. Our site runs Google Analytics by default. A short notice at the bottom of the page says so, with an “Agree” button and a link to our Opt-out preferences page. There you can turn Statistics (Google Analytics) off. Turning it off stops analytics right away, removes its cookies, and keeps it off on later visits from the same browser. You can change your choice at any time with “Opt-out preferences” in the page footer. If your browser sends a Global Privacy Control signal, we treat it as an opt-out, and analytics never starts.
Essential. Your choice itself is saved in your browser’s local storage (the key is och-cookies). Our quote and question forms also use Cloudflare Turnstile to tell people from automated bots. When you open the quote form, or click into the question form on the contact page, Cloudflare receives technical information from your browser, such as your IP address, to run that check. We use it only to protect the form from spam, and Cloudflare handles that information under its own privacy policy.
Analytics (on unless you opt out). Google Analytics sets cookies (named _ga and _ga_ followed by an ID) to count visits. It receives the pages you view (the page address without anything after a question mark), the page you came from (also without anything after a question mark), and interactions such as tapping our phone number, sending a quote request or a question, and the quote step you reached. It never receives what you type into our forms, such as your name, phone number, email address, income, ZIP code, or answers about your household or health. Google also receives standard technical information, such as your IP address and your device and browser details.
Cloudflare Web Analytics. Cloudflare, which hosts our site, also counts page views with its Web Analytics tool. It sets no cookies and does not identify you.
We will process legally recognized browser-based opt-out preference signals, such as Global Privacy Control, when required by applicable law and when our systems can reasonably associate the signal with your browser or device.
At this time, there is no universally accepted standard requiring websites to respond to ordinary “Do Not Track” browser settings. We therefore do not represent that the website responds to every Do Not Track signal.
Opting out on one browser or device may not automatically apply to another browser or device.
8. Sensitive Personal Information
Some information you provide may be considered sensitive under state privacy laws, including information concerning health, prescriptions, insurance coverage, government identifiers, or account credentials.
We use sensitive information only as reasonably necessary to:
- Provide insurance services you request;
- Compare available plans;
- Complete an application or enrollment;
- Service an existing policy;
- Prevent fraud or protect security; or
- Meet legal, carrier, Marketplace, and regulatory obligations.
We do not use sensitive personal information to infer characteristics about you for unrelated advertising.
Obamacare Hotline is an insurance agency and does not represent that all information it handles is governed by the Health Insurance Portability and Accountability Act (“HIPAA”). When HIPAA or another health-information privacy law applies to particular information or activities, we handle the information in accordance with the applicable requirements.
9. Data Retention
We retain personal information for only as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services and meet legal, regulatory, carrier, contractual, accounting, and compliance requirements.
Retention periods depend on the type of information and the reason it was collected. For example:
- Marketplace enrollment records and consent records may be retained for ten years or another period required by federal Marketplace rules;
- Application, enrollment, policy, and servicing records may be retained while a policy remains active and for the period required afterward by law, regulators, carriers, or contractual obligations;
- Records relating to inquiries that do not result in an application may be retained for a reasonable period to respond to the inquiry, document consent, resolve disputes, and meet legal obligations;
- Technical, security, and website records may be retained for fraud prevention, troubleshooting, analytics, and security purposes; and
- Information may be retained longer when reasonably necessary for litigation, an investigation, an audit, a legal hold, or enforcement of an agreement.
When information is no longer reasonably needed, we may delete, de-identify, or securely dispose of it.
10. Information Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Depending on the circumstances, these safeguards may include access restrictions, encryption during transmission, authentication controls, logging, staff training, vendor oversight, backups, and incident-response procedures.
No website, transmission method, or storage system can be guaranteed to be completely secure. You should use care when sending sensitive information electronically and should contact us before transmitting highly sensitive information through an ordinary email or website form.
If a security incident affects personal information, we will investigate and provide notices when required by applicable law.
11. Your Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- Confirm whether we process your personal information;
- Request access to personal information we maintain about you;
- Request correction of inaccurate information;
- Request deletion of certain information;
- Request a portable copy of certain information;
- Opt out of certain sales, sharing, or targeted advertising;
- Limit certain uses or disclosures of sensitive personal information;
- Withdraw consent where processing is based on consent;
- Appeal a decision concerning a privacy request; and
- Receive equal service and pricing without unlawful discrimination for exercising a privacy right.
These rights are not absolute. We may deny or limit a request when an exception applies, including when information must be retained to comply with Marketplace requirements, insurance laws, carrier requirements, legal obligations, fraud-prevention needs, or an existing insurance relationship.
To submit a privacy request, contact us using the information below. Please describe your request and identify the state in which you reside.
We may need to verify your identity before completing the request. We will use information provided during verification only to confirm identity and process the request.
An authorized agent may submit a request on your behalf when permitted by law. We may require proof of the agent’s authority and may ask you to verify your identity directly.
We will respond within the period required by applicable law.
12. Children’s Privacy
Our website and insurance services are intended for adults and are not directed to children under 13. Information about children is collected only from a parent or guardian applying for coverage on the child’s behalf.
We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information through our website, contact us so that we can review and, when appropriate, delete it.
13. Third-Party Websites
Our website may link to HealthCare.gov, Get Covered Illinois, insurance-carrier websites, social-media platforms, scheduling services, and other third-party websites or services.
We do not control the privacy or security practices of third parties. Information you provide directly to another website or platform is governed by that party’s policies.
14. Social Media
When you communicate with us through Facebook, Instagram, YouTube, LinkedIn, Yelp, or another social-media platform, both Obamacare Hotline and the platform may receive information about the interaction.
Do not post Social Security numbers, detailed medical information, or other sensitive information in a public comment or post.
15. United States Operations
Obamacare Hotline is based in the United States, and our services are intended for people located in the United States.
Information may be stored and processed in the United States. If you access the website from another country, you understand that its privacy laws may differ from those in your location.
16. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our services, legal requirements, technology, or business practices.
When we update the policy, we will revise the “Last Updated” date. When required by law, we will provide additional notice or request consent before applying a material change to information previously collected.
